Successful Prosecutions For Breaches Of Planning Laws

Borough of Poole has successfully prosecuted two local businesses and two individuals for breaches of planning laws with total fines and costs of over £6,200.

All cases were heard at Wimborne Magistrates Court link will open in new window on the 29 October 2007.

Mr Marc Clark of 15a Bury Road, Branksome Park was fined £2,000 with costs of £940 for breach of a Tree Preservation Order (TPO). Mr Clark was not in court but pleaded guilty by email to damaging protected trees during a garden makeover, despite knowing that the trees were protected. In written mitigation, Mr Clark apologised to the court and confirmed that the matters had now been addressed.

Mr Brian Raine of 131 Churchill Road was fined £100 with costs of £400 for breach of an Untidy Site Notice relating to his garden. In mitigation, he told the court that he was clearing the site, but acknowledged that it was still a visual eyesore. The court advised Mr Raine to resolve the problem promptly to avoid a further court appearance.

J.L.K. Limited of Ashley Road, Parkstone was fined £1,000 with costs of £165 for breach of advertising regulations under the Town and Country Planning Act 1990 link will open in new window. J.L.K Limited had placed illegal advertising boards on the public highway outside their premises on Ashley Road. Borough of Poole acted after complaints that they were hazardous to pedestrians. Despite repeated warnings the signs continued to be displayed before being seized by Borough of Poole.

A&E Autos of 16 Ringwood Road, Poole was fined £1,000 with costs of £615 for breach of advertising regulations under the Town and Country Planning Act 1990. A&E Autos had illegally displayed signs on a neighbouring property without their consent. Borough of Poole seized the signs after the garage refused to remove them.

Andy Dearing, Enforcement Officer, Borough of Poole, said: "These cases demonstrate our commitment to prosecute flagrant breaches of planning law. These types of offences have a serious effect on both the amenity and the quality of people's lives in Poole and the level of fines reflects how serious the courts view them."
